MEMORANDUM OPINION

Energy Transfer Group, L.L.C., has filed a motion asking this Court to dismiss its cross-appeal brought in the appeal numbered 06-04-00125-CV against the plaintiffs (appellants) in the action below, Retro Compression, L.L.C., Genergistics, L.L.C., Terry Nixon, Individually, Grayson Cord Ederer, Individually, John Manning, Individually, and OGS Oakhill Pipeline, Inc. In order to provide the relief sought, we order the cross-appeal severed from the main body of this case and we assign it cause number 06-04-00133-CV.

We grant the motion and dismiss the cross-appeal.
