BRAD BINAU, JAMES CHILDS, DENNIS ANDERSON,

& ALLAN SAGER, Appellants

V.

JANE ALFRED DOE, ET AL., Appellees

On Appeal from the 71st Judicial District Court

Harrison County, Texas

Trial Court No. 02-0157

Before Morriss, C.J., Ross and Carter, JJ.

Memorandum Opinion by Chief Justice Morriss

MEMORANDUM OPINION

Appellants move this Court to dismiss their appeal. In their motion, Appellants state that the trial court signed an agreed order vacating the earlier denial of Appellants' special appearance and that, as a result, Appellants no longer wish to pursue the appeal. Their motion complies with the requirements set forth in Tex. R. App. P. 42.1. The rule authorizes this Court to dismiss an appeal on the filing of a proper motion by the appellant.

Accordingly, we grant Appellants' motion and dismiss the appeal.

Josh R. Morriss, III

Chief Justice
