Pending before the court is the motion by the Texas Department of Protective and
Regulatory Services (TDP) to dismiss the appeal of Phillip Goldsmith (Phillip) for want of
jurisdiction. Through this motion, the TDP had also sought to dismiss the appeal of Leigh
Goldsmith (Leigh). We previously granted the motion as it pertained to Leigh but omitted
to dismiss as to Phillip.
Thus, the opinion and ensuing judgment was not final.
Furthermore, this omission was brought to our attention by the TDP.
For the reasons stated in our opinion dated July 2, 2002, styled In re J.A.G., a Child,
Cause No. 07-02-0154-CV, we grant TDP’s motion as it relates to Phillip Goldsmith and
dismiss his appeal for want of jurisdiction. With this opinion, the entire appeal perfected
by all parties now is dismissed.
