COURT OF APPEALS SECOND DISTRICT OF TEXAS FORT WORTH NO. 02-18-00103-CV DAVID ODOM APPELLANT V. CHRISTOPHER DILLON SNELL, BRIAN LOCKHART, IMPROMPTU COMMUNICATIONS, LLC, TODD CRAIN, AND JAMES L. SPRINGER, JR. APPELLEES ---------FROM THE 17TH DISTRICT COURT OF TARRANT COUNTY TRIAL COURT NO. 017-279460-15 ---------- MEMORANDUM OPINION 1 ---------Appellant David Odom attempts to appeal the trial court’s December 11, 2017 judgment. He timely filed a motion for new trial on January 10, 2018; his 1 See Tex. R. App. P. 47.4. notice of appeal was therefore due March 12, 2018 but was not filed until March 29, 2018, making it untimely. See Tex. R. App. P. 26.1. On April 2, 2018, we notified the parties of our concern that we lack jurisdiction over this appeal based on Appellant’s untimely filed notice of appeal and warned that we could dismiss this appeal absent a response by April 12, 2018 showing grounds for continuing the appeal. We have received no response. The time for filing a notice of appeal is jurisdictional in this court, and absent a timely filed notice of appeal or timely filed motion for extension of time to file a notice of appeal, we must dismiss the appeal. See Tex. R. App. P. 25.1(b), 26.3; Verburgt v. Dorner, 959 S.W.2d 615, 617 (Tex. 1998). Because Appellant’s notice of appeal was filed too late, we dismiss this appeal for want of jurisdiction. See Tex. R. App. P. 26.1, 42.3(a), 43.2(f). PER CURIAM PANEL: PITTMAN, J.; SUDDERTH, C.J.; and BIRDWELL, J. DELIVERED: May 17, 2018 2
