In The Court of Appeals Ninth District of Texas at Beaumont _________________ NO. 09-16-00064-CV _________________ IN RE PAUL F. FERGUSON JR. AND PAUL F. FERGUSON, P.C. ________________________________________________________________________ Original Proceeding 60th District Court of Jefferson County, Texas Trial Cause No. A-197,499 ________________________________________________________________________ MEMORANDUM OPINION Paul F. Ferguson Jr. and Paul F. Ferguson, P.C., the Relators, filed a petition for a writ of mandamus and a motion for temporary relief. See Tex. R. App. P. 52.1, 52.10. Relators contend the visiting judge assigned to preside in the case abused its discretion in compelling arbitration pursuant to a partnership agreement. Relators ask this Court to compel the trial court to withdraw its order of December 18, 2015, which compelled arbitration under a partnership agreement, and compel arbitration under a settlement agreement that Relators contend superseded the partnership agreement. After reviewing the motion for temporary relief, the 1 petition for writ of mandamus, and the accompanying mandamus record, we conclude that Relators have not shown that they are entitled to mandamus relief. We deny the petition for writ of mandamus and the motion for temporary relief. See Tex. R. App. P. 52.8. PETITION DENIED. PER CURIAM Submitted on March 2, 2016 Opinion Delivered March 3, 2016 Before McKeithen, C.J., Horton and Johnson, JJ. 2
