Fourth Court of Appeals San Antonio, Texas MEMORANDUM OPINION No. 04-18-00987-CR Otis GREER, Appellant v. The STATE of Texas, Appellee From the 227th Judicial District Court, Bexar County, Texas Trial Court No. 1992CR1623W Judge Mike M. Machado, Judge Presiding PER CURIAM Sitting: Luz Elena D. Chapa, Justice Irene Rios, Justice Beth Watkins, Justice Delivered and Filed: January 23, 2019 DISMISSED FOR LACK OF JURISDICTION Otis Greer has filed a notice of appeal from his 1992 conviction for aggravated sexual assault. The trial court imposed a life sentence on May 1, 1992; Greer’s notice of appeal was due thirty days later on June 1, 1992. Greer filed his notice of appeal on December 28, 2018. Because the notice of appeal in this case was not timely filed, we lack jurisdiction to entertain the appeal. See Slaton v. State, 981 S.W.2d 208, 210 (Tex. Crim. App. 1998) (holding that if appeal is not timely perfected, court of appeals does not obtain jurisdiction to address merits 04-18-00987-CR of appeal, and court may take no action other than to dismiss appeal; court may not suspend rules to alter time for perfecting appeal).
