The STATE of Texas, Appellee From the County Court at Law, Kerr County, Texas Trial Court No. CR-150462-CR Honorable Susan Harris, Judge Presiding PER CURIAM Sitting: Sandee Bryan Marion, Chief Justice Karen Angelini, Justice Jason Pulliam, Justice Delivered and Filed: April 6, 2016 DISMISSED On February 22, 2016, this court abated this appeal for the second time for the trial court to determine whether appellant desires to prosecute this appeal, whether appellant is indigent and to appoint counsel on appeal. Because appellant failed to appear for a previous hearing, appellant was admonished that if she failed to appear again, this court must construe her failure to appear for the trial court hearings and failure to prosecute the appeal as notice of her desire to forfeit prosecution of appeal. This court instructed that the appeal would be dismissed based upon appellant’s abandonment. 04-15-00731-CR Appellant failed to appear for the hearing. A supplemental clerk’s record and reporter’s record were filed documenting appellant was notified of the hearing at her last known address and failed to appear. We, therefore, dismiss the appeal based upon appellant’s abandonment and failure to prosecute. PER CURIAM DO NOT PUBLISH -2-
