Michael A. Miranda v. The State of Texas--Appeal from 289th Judicial District Court of Bexar County

Annotate this Case
MEMORANDUM OPINION
No. 04-08-00094-CR
Michael A. MIRANDA,
Appellant
v.
The STATE of Texas,
Appellee
From the 289th Judicial District Court, Bexar County, Texas
Trial Court No. 2007-CR-2903B
Honorable Carmen Kelsey, Judge Presiding

PER CURIAM

Sitting: Catherine Stone, Justice

Karen Angelini, Justice

Sandee Bryan Marion, Justice

Delivered and Filed: May 21, 2008

DISMISSED FOR WANT OF JURISDICTION

The trial court imposed appellant's sentence on November 26, 2007. Because appellant did not timely file a motion for new trial, his notice of appeal was due no later than December 26, 2007. Tex. R. App. P. 26.2. The notice of appeal was not filed until January 11, 2008, and no motion for extension of time was filed. Tex. R. App. P. 26.3.

On April 1, 2008, this court notified appellant that the clerk's record did not show the jurisdiction of this court, see Olivo v. State, 918 S.W.2d 519, 522 (Tex. Crim. App. 1996), and we gave appellant until April 30, 2008 to show cause why his appeal should not be dismissed for want of jurisdiction. In appellant's response to our order, appellant concedes that this court lacks jurisdiction over his appeal. Accordingly, this appeal is dismissed for want of jurisdiction.
