Dan Church v. La Mansion Hotels, Ltd.--Appeal from County Court at Law No 3 of Bexar County
Annotate this CaseNo. 04-08-00112-CV
Dan CHURCH,
Appellant
v.
LA MANSION HOTELS, LTD.,
Appellee
From County Court at Law No. 3, Bexar County, Texas
Trial Court No. 319862
Honorable H. Paul Canales, Judge Presiding
PER CURIAM
Sitting: Karen Angelini, Justice
Sandee Bryan Marion, Justice
Phylis J. Speedlin, Justice
Delivered and Filed: April 30, 2008
DISMISSED
The trial court clerk's record was due on January 1, 2008. On February 15, 2008, the trial court clerk filed a notification of late record, stating that the clerk's record was not filed because appellant, Dan Church, failed to pay or make arrangements to pay the clerk's fee for preparing the record and that Church was not entitled to appeal without paying the fee.
We, therefore, ordered Church to provide written proof to this court no later than April 7, 2008, that either (1) the clerk's fee had been paid or arrangements had been made to pay the clerk's fee; or (2) Church was entitled to appeal without paying the clerk's fee. We warned Church that if he failed to respond within the time provided, this appeal would be dismissed for want of prosecution. See Tex. R. App. P. 37.3(b).
As Church has failed to comply with this court's order, we dismiss this appeal.
PER CURIAM
