Annotate this CaseMEMORANDUM OPINION
No. 04-07-00270-CV
Richard E. SNELL,
Appellant
v.
Magdalena M. SNELL,
Appellee
From the 216th Judicial District Court, Kendall County, Texas
Trial Court No. 06-302
Honorable Charles Sherrill, Judge Presiding
PER CURIAM
Sitting: Sandee Bryan Marion, Justice
Phylis J. Speedlin, Justice
Rebecca Simmons, Justice
Delivered and Filed: December 5, 2007
DISMISSED FOR WANT OF PROSECUTION
Appellant's brief was originally due on August 22, 2007. On September 5, 2007, this court notified appellant that the brief was late and asked appellant to provide a reasonable explanation for the delay no later than September 17, 2007. Neither the brief nor a response was filed. On September 27, 2007, this court ordered appellant to file appellant's brief no later than October 22, 2007. Our order informed appellant that if the brief was not filed by October 22, 2007 this appeal would be subject to dismissal for want of prosecution. See Tex. R. App. P. 38.8(a). Neither the brief nor a motion for extension of time was filed. Accordingly, on November 6, 2007, this court ordered appellant to show cause in writing why this appeal should not be dismissed for want of prosecution. See Tex. R. App. P. 38.8(a). Appellant did not respond. The appeal is dismissed for want of prosecution. See Tex. R. App. P. 38.8(a)(1), 42.3(b). Costs of appeal are taxed against appellant.
