DISMISSED FOR WANT OF PROSECUTION

 

After failed mediation, this case was reinstated on this court's docket on July 16, 2007. Appellant's brief was, therefore, due to be filed no later than August 20, 2007. On August 27, 2007, after neither a brief nor a motion for extension of time was filed, this court ordered Appellant to show cause in writing, no later than September 11, 2007, why this appeal should not be dismissed for want of prosecution. See Tex. R. App. P. 38.8(a). We received no response. As of this date, Appellant has not responded to the court's order. The appeal, therefore, is dismissed for want of prosecution. See Tex. R. App. P. 38.8(a)(1), 42.3(b). Costs of appeal are taxed against Appellant.
