Cuarto Petro Corp. v. McGill Real Estate, LLC--Appeal from 365th Judicial District Court of Dimmit County
Annotate this CaseMEMORANDUM OPINION
No. 04-06-00788-CV
CUARTO PETRO CORP.,
Appellant
v.
MCGILL REAL ESTATE, LLC,
Appellee
From the 365th Judicial District Court, Dimmit County, Texas
Trial Court No. 04-11-10107-DCVAJA
Honorable Ron Carr , Judge Presiding
PER CURIAM
Sitting: Catherine Stone , Justice
Sarah B. Duncan , Justice
Karen Angelini , Justice
Delivered and Filed: December 27, 2006
DISMISSED FOR WANT OF JURISDICTION
Appellee, McGill Real Estate, LLC, filed a motion to dismiss this appeal for want of jurisdiction because the trial court's summary judgment order does not dispose of all of the underlying causes of action and no severance order appears in the record. We subsequently ordered appellant, Cuarto Petro Corp., to file a response to the motion to dismiss. On December 14, 2006, we received appellant's response. Appellant's response, however, fails to demonstrate that the trial court's judgment is a final and appealable judgment. It is therefore ordered that appellee's motion to dismiss is granted, and this appeal is dismissed for want of jurisdiction. See Lehmann v. Har Con Corp., 39 S.W.3d 191, 195 (Tex. 2001).
