DISMISSED FOR LACK OF JURISDICTION

Appellant is appealing from the denial of an application for writ of habeas corpus filed in the trial court. In its order, the trial court specifically states that it is refusing to consider the merits of the application for writ of habeas corpus. We do not have jurisdiction to review a denial of an application for a writ of habeas corpus. Ex parte Hargett, 819 S.W.2d 866, 868 (Tex. Crim. App. 1991). We can only review a ruling on the merits of the claim. Id.

We, therefore, ordered appellant to show cause why this appeal should not be dismissed for lack of jurisdiction. Appellant has failed to file a response.

We dismiss this appeal for lack of jurisdiction.
