v.

The STATE of Texas,

Appellee

From the 175th Judicial District Court, Bexar County, Texas

Trial Court No. 2003-CR-1420

Honorable Mary Rom n, Judge Presiding

PER CURIAM

Sitting: Sarah B. Duncan , Justice

Karen Angelini , Justice

Sandee Bryan Marion , Justice

Delivered and Filed: October 18, 2006

DISMISSED

On August 21, 2006, we abated this appeal and remanded the case to the trial court to conduct a hearing to determine whether Christopher Martinez desired to prosecute his appeal. The trial court received Martinez's sworn affidavit indicating he does not want to prosecute his appeal. The trial court concluded "that [Martinez] does not wish to pursue his appeal nor does [he] wish to have an attorney appointed to him in order to pursue the appeal." We adopt the trial court's findings and conclusions and order this appeal dismissed for want of prosecution.
