PETITION FOR WRIT OF MANDAMUS DISMISSED

On June 19, 2006, relator filed a petition for writ of mandamus. Real party in interest filed a motion to dismiss alleging this court does not have jurisdiction over the matter because the complained-of order was signed by the Honorable Juan Partida, Presiding Judge of the 275th Judicial District of Hidalgo County. This court may not issue a writ of mandamus against a judge not in our district. Tex. Gov't Code Ann. 22.221(b) (Vernon 2004). Therefore, the petition is DISMISSED.

Relator shall pay all costs incurred in this proceeding.

1. This proceeding arises out of Cause No. F-1591-01-E, styled In the Interest of Matthew Lee Stanley and Sarah Katherine Stanley, Minor Children, filed in the 275th Judicial District Court, Hidalgo County, Texas.
