MEMORANDUM OPINION
No. 04-04-00473-CV
IN RE John B. WILLIAMS,
Original Mandamus Proceeding (1)

PER CURIAM

Sitting: Alma L. L pez, Chief Justice

Catherine Stone, Justice

Sarah B. Duncan, Justice

Delivered and Filed: July 14, 2004

PETITION FOR WRIT OF MANDAMUS DISMISSED FOR WANT OF JURISDICTION

Relator John B. Williams filed a petition for a writ of mandamus alleging that the Bexar County District Clerk Margaret Montemayor has failed to act as required by law in four civil suits filed by relator in the Bexar County district courts. This court does not have mandamus jurisdiction over district clerks unless it is shown the issuance of the writ is necessary to enforce our jurisdiction. See Tex. Gov't Code Ann. 22.221(a), (b) (Vernon 2004); In re Simpson, 997 S.W.2d 939 (Tex. App.-Waco 1999, orig. proceeding). Relator has made no such allegation or showing. We therefore dismiss the petition for want of jurisdiction.

No costs shall be assessed against relator because he is indigent.

PER CURIAM

1. This proceeding relates to Cause Nos. 2003-CI-07338, 2003-CI-14620, 2003-CI-15466, and 2003-CI-07675, all of which were filed by relator in the district courts of Bexar County, Texas.
