IN RE Jesse MATA

Original Mandamus Proceeding (1)

PER CURIAM

Sitting: Sarah B. Duncan, Justice

Sandee Bryan Marion, Justice

Phylis J. Speedlin, Justice

Delivered and filed: December 10, 2003

PETITION FOR WRIT OF MANDAMUS DENIED

On December 1, 2003, relator filed a petition for writ of mandamus in this court. In his petition, relator seeks to compel the Texas Department of Criminal Justice to correct his records to reflect credit for time served. Relator also asks that this court enjoin the Texas Department of Criminal Justice from altering the original judgment in his case. We have no mandamus jurisdiction over the Texas Department of Criminal Justice, and relator has not shown that the writ is necessary

to enforce this court's jurisdiction. See Tex. Gov't. Code Ann. 22.221 (Vernon Supp. 2003). Therefore, the petition is DENIED. Tex. R. App. P. 52.8(a).

PER CURIAM

1. Relator's complaint is with regard to a judgment entered in Cause No. 1992-CR-2056-B, styled The State of Texas v. Jesse Mata, in the 226th Judicial District Court, Bexar County, Texas.
