PETITION FOR WRIT OF MANDAMUS DENIED

On November 3, 2003, relator filed a petition for writ of mandamus, asking this court to order respondent to vacate his order denying relator an examining trial pursuant to Texas Code of Criminal Procedure 16.01. On November 12, 2003, the real party in interest filed a copy of an indictment returned against relator on November 7, 2003. Accordingly, relator is not entitled to the relief sought in her petition. Therefore, the petition is DENIED. Tex. R. App. P. 52.8(a).

Relator shall pay all costs incurred in this proceeding.
