Delivered and Filed: November 12, 2003
PETITION FOR WRIT OF MANDAMUS DISMISSED FOR WANT OF JURISDICTION
Relator, Santiago "Jimmy" Lopez, filed a petition for writ of mandamus in which he asks this court to order Dora Elia Sandoval, the County and District Clerk of Kinney County to accept and file a pleading. We have no mandamus jurisdiction over district clerks unless it is shown the issuance of the writ is necessary to enforce our jurisdiction. See Tex. Gov't Code Ann. 22.221(a), (b) (Vernon Supp. 2002); In re Simpson, 997 S.W.2d 939 (Tex. App.-Waco 1999, orig. proceeding). Relator has made no such allegation or showing. We therefore dismiss the petition for want of jurisdiction.
No costs shall be assessed against relator because he is indigent. The clerk of this court is directed to transmit a copy of this opinion to relator and respondent.
