On October 3, 2003, we ordered the trial court to conduct a hearing to determine whether appellant desired to prosecute his appeal or whether his counsel had abandoned the appeal. On October 9, 2003, appellant filed a motion to dismiss the appeal signed by the appellant and his counsel.

Our order of October 3, 2003 is withdrawn and the appeal is reinstated. Appellant's motion to dismiss is granted and the appeal is dismissed.
