MEMORANDUM OPINION
No. 04-03-00695-CV

IN RE Donald J. BIERSCHWALE, Jeannette L. Bierschwale, Edward A. Bierschwale, John E.

Bierschwale, Dorothy Parham, and Kim Schroeder
Original Mandamus Proceeding (1)

PER CURIAM

Sitting: Alma L. L pez, Chief Justice

Sarah B. Duncan, Justice

Phylis J. Speedlin, Justice

Delivered and Filed: October 8, 2003

PETITION FOR WRIT OF MANDAMUS DENIED

On September 16, 2003, relators filed a petition for writ of mandamus and motion to transfer the record in a related proceeding. We granted the motion to transfer. The court has considered relators' petition for writ of mandamus alleging the trial court abused its discretion when it denied relators' motion to compel responses to post-judgment discovery. This court has determined relators are not entitled to the relief sought. Accordingly, relators' petition for writ of mandamus is denied. See Tex. R. App. P. 52.8(a). Relators shall pay all costs incurred in this proceeding.

The clerk of the court is directed to transmit a copy of this opinion to the attorneys of record, the trial court judge, and the trial court clerk.

Frontier Ins. Co., pending in the 224th Judicial District Court, Bexar County, Texas, the Honorable Karen Pozza presiding.
