In the Interest of Ashley Shelton, A Minor Child--Appeal from 166th Judicial District Court of Bexar County

Annotate this Case
No. 04-01-00235-CV
IN THE INTEREST OF Ashley SHELTON, a Minor Child,
From the 166th Judicial District, Bexar County, Texas
Trial Court No. 1999-CI-07441
Honorable Frank Montalvo, Judge Presiding

PER CURIAM

Sitting: Phil Hardberger, Chief Justice

Tom Rickhoff, Justice

Karen Angelini, Justice

Delivered and Filed: June 27, 2001

DISMISSED FOR LACK OF JURISDICTION

On February 2, 2001, Jack Shelton was held in contempt for failure to make child support payments. Shelton appealed the contempt order to this court. This court, however, does not have jurisdiction to review contempt orders by direct appeal. Norman v. Norman, 692 S.W.2d 655, 655 (Tex. 1985). Rather, contempt orders may be reviewed only by an application for writ of habeas corpus, if the contemner has been confined, or by petition for writ of mandamus, if the contemner has not been confined. See Rosser v. Squier, 902 S.W.2d 962, 962 (Tex 1995); Ex parte Williams, 690 S.W.2d 243, 243 n.1 (Tex. 1985). Accordingly, this court ordered Shelton to show cause why his appeal should not be dismissed for lack of jurisdiction. Shelton has not responded.

Therefore, this appeal is dismissed for lack of jurisdiction. See Tex. R. App. P. 42.3(a). Costs of appeal are taxed against Shelton.
