No. 04-01-00140-CR
EX PARTE Keith Allan VOLWILER
From the 186th Judicial District Court, Bexar County, Texas
Trial Court No. 2000-CR-4687-B
Honorable Sharon MacRae, Judge Presiding (1)

PER CURIAM

Delivered and Filed: April 30, 2001

DISMISSED AS MOOT

Keith Allan Volwiler ("Volwiler") appeals an order entered in a habeas corpus proceeding seeking a reduction in bond. In his appellate brief, Volwiler raises two issues, asserting that the bond remained excessively high and that he was entitled to be released on personal bond. The State has filed a motion to dismiss the appeal as moot, claiming that the charges against Volwiler have been dismissed and the sheriff has been given authority to release Volwiler. The State attached the order of dismissal to its motion. Because the indictment has been dismissed and Volwiler has been released from custody, this appeal is dismissed as moot. Ex parte Spivey, 382 S.W.2d 491, 491 (Tex. Crim. App. 1964).
