Annotate this CaseMaria Adah ALDRETE, Daisy Morales, and Monica Guajardo,
Appellants
v.
CITY OF SAN ANTONIO, and Union Pacific Railroad d/b/a Southern Pacific Lines,
Appellees
From the 37th Judicial District Court, Bexar County, Texas
Trial Court No. 97-CI-17184
Honorable David Berchelmann, Judge Presiding
PER CURIAM
Sitting: Catherine Stone, Justice
Paul W. Green, Justice
Sarah B. Duncan, Justice
Delivered and Filed: November 1, 2000
DISMISSED FOR LACK OF PROSECUTION
On September 12, 2000, the trial court clerk responsible for the clerk's record in this case notified this court that the record had not been filed because appellants have failed to pay or make arrangements to pay the clerk's fee for preparing the record and that appellants are not entitled to appeal without paying the fee.
On October 3, 2000, we ordered appellants to provide written proof to this court by October 13, 2000, that either the (1) the clerk's fee has been paid or arrangements have been made to pay the clerk's fee; or (2) appellants are entitled to appeal without paying the clerk's fee. Appellants were warned that their failure to respond within the time provided would result in dismissal for lack of prosecution. See Tex. R. App. P. 37.3(b).
We have received no response. Accordingly, the appeal is dismissed for lack of prosecution. Costs of the appeal are taxed against appellants.
