AFFIRMED

A jury found David Norfleet guilty of driving while intoxicated and the trial court sentenced him to six months in jail and a nine hundred dollar fine. The sentence was suspended and Norfleet was placed on probation for a period of two years. He timely appealed. However, appellant did not file a brief and, and after a hearing held pursuant to Rule 38.8(b), Tex. R. App., the trial court found

appellant no longer desires to pursue the appeal. Although this court notified appellant of the requirements of Rule 42.2(a), he has not filed a motion to withdraw his notice of appeal. We therefore consider the appeal on the record alone. See Tex. R. App. P. 38.8(b)(1),(4). Having reviewed the record and found no reversible error, we affirm the trial court's judgment.
