PETITION FOR WRIT OF MANDAMUS DISMISSED AND STAY OF TRIAL COURT'S ORDER LIFTED
On October 13, 1998, this court granted temporary relief on relator's petition for writ of mandamus, staying the trial court's order compelling discovery and issuing sanctions. Relator has now filed a motion to dismiss the petition for writ of mandamus because the parties have settled the underlying dispute. We grant the motion to dismiss the petition for writ of mandamus and lift the stay of the trial court's order dated October 5, 1998. See Tex. R. App. P. 42.1(a)(2). Costs are taxed against the parties who incurred them.
