DISTRICT ATTORNEY, BRIAN MIDDLETON, Appellee On Appeal from the 268th District Court Fort Bend County, Texas Trial Court Cause No. 22-DCV-290442 MEMORANDUM OPINION This is an appeal from the trial court’s order signed September 21, 2023 dismissing appellant’s claims against the State of Texas for want of prosecution.1 Appellant’s brief was due December 7, 2023. No brief or motion to extend time was filed. 1 Appellant has also filed an appeal in case number 14-22-00881-CV, disputing the trial court’s order signed September 20, 2022 which dismissed his claims against District Attorney Brian Middleton and declared appellant to be a vexatious litigant. That appeal remains pending. On January 11, 2024, we issued an order stating that unless appellant filed a brief on or before February 12, 2024, the appeal was subject to dismissal without further notice for want of prosecution. See Tex. R. App. P. 42.3(b). Appellant filed no brief or other response. We dismiss the appeal for want of prosecution. PER CURIAM Panel consists of Justices Spain, Poissant, and Wilson. 2
