Motion Denied and Memorandum Dissenting Opinion on Order filed August 30, 2023. In The Fourteenth Court of Appeals NO. 14-23-00587-CV ROMARIO JOAO BENTO, Appellant V. CRAIGTISHA LACOLE GREEN, Appellee On Appeal from the 309th District Court Harris County, Texas Trial Court Cause No. 2019-88853 MEMORANDUM DISSENTING OPINION In this appeal of the trial court’s August 11, 2023 final order in a suit affecting the parent-child relationship, appellant Romario Joao Bento has filed an (1) August 18, 2023 emergency motion to stay the trial court’s final order and (2) August 21, 2023 emergency motion to stay the trial court’s final order. No clerk’s record has yet been filed, and the documents attached to the motions as appendices have not been verified as required by Texas Rule of Appellate Procedure 10.2. See Tex. R. App. P. 10.2. While appellant need not amend the August 18, 2023 motion that is now moot in light of the August 21, 2023 motion, appellant should be notified that the August 21, 2023 motion will be dismissed for want of prosecution if it is not amended to comply with Rule 10.2. Because the court does not give appellant notice and an opportunity to cure, I respectfully dissent. /s/ Charles A. Spain Justice Panel consists of Justices Jewell, Spain, and Wilson (Spain, J., dissenting). 2
