Petition for Writ of Mandamus Dismissed and Opinion filed June 23, 2016. In The Fourteenth Court of Appeals NO. 14-16-00422-CV IN RE TOMYSHIA COULON AND FARMERS TEXAS COUNTY MUTUAL INSURANCE COMPANY, Relators ORIGINAL PROCEEDING WRIT OF MANDAMUS 151st District Court Harris County, Texas Trial Court Cause No. 2015-76887 MEMORANDUM OPINION On May 25, 2016, relators, Tomyshia Coulon and Farmers Texas County Mutual Insurance Company, filed a petition for writ of mandamus in this court. See Tex. Gov’t Code Ann. § 22.221 (West 2004); see also Tex. R. App. P. 52. In the petition, relator asks this court to compel the Honorable Mike Engelhart, presiding judge of the 151st District Court of Harris County, to vacate his April 11, 2016 order granting William Brenner’s petition to take a pre-suit deposition pursuant to Texas Rule of Civil Procedure 202. See Tex. R. Civ. P. 202. On May 31, 2016, relators also filed a motion for emergency stay. On June 13, 2016, Brenner filed in this court a notice of dismissal, advising that he had filed a notice of dismissal of the suit in the trial court. Relators’ requested relief in the petition for writ of mandamus is now moot. Accordingly, we order relators’ petition for writ of mandamus dismissed for lack of jurisdiction. We further deny relators’ motion for emergency stay denied as moot. PER CURIAM Panel consists of Justices Busby, Donovan, and Wise. 2
