KENDRA BIRCHFIELD, Appellee On Appeal from the 387th District Court Fort Bend County, Texas Trial Court Case No. 13-DCV-204573 MEMORANDUM OPINION Appellant, William D. Birchfield, has filed a motion to dismiss his appeal, stating that the parties have reached a settlement agreement resolving their underlying dispute. Although appellant failed to include a certificate of conference with his motion, more than ten days have passed, and appellee, Kendra Birchfield, has not expressed opposition to appellant’s motion. See TEX. R. APP. P. 10.3(a). No other party has filed a notice of appeal, and no opinion has issued. See TEX. R. APP. P. 42.1(a)(1), (c). Accordingly, we grant the motion and dismiss the appeal.
