Opinion issued November 10, 2020 In The Court of Appeals For The First District of Texas ———————————— NO. 01-20-00607-CV ——————————— IN RE REPUBLIC TITLE OF TEXAS, INC., Relator Original Proceeding on Petition for Writ of Mandamus MEMORANDUM OPINION Relator, Republic Title of Texas, Inc., filed a petition for writ of mandamus requesting that this Court vacate portions of the trial court’s August 3, 2020 summary judgment order and August 24, 2020 clarifying order, to the extent that the orders would require relator to release certain earnest money funds prior to the entry of a final judgment.1 Relator also filed a “Motion for Emergency Relief to Stay 1 The underlying case is Fairway Pads, Ltd. v. On August 27, 2020, the Court granted relator’s request for emergency relief. Relator has filed a motion to dismiss the petition for writ of mandamus. In the motion, relator represents that on September 24, 2020, the trial court entered a final judgment disposing of all claims, thereby rendering relator’s petition moot. More than ten days have passed, and no party has expressed opposition to relator’s motion. Accordingly, we grant relator’s motion, dismiss the petition, and lift the stay imposed by our August 27, 2020 order. We dismiss all pending motions as moot.
