WILFREDO REYES, Appellee On Appeal from the 247th District Court Harris County, Texas Trial Court Cause No. 2013-23378 MEMORANDUM OPINION Appellant, Yenein Abreu, has failed to timely file her appellate brief. See TEX. R. APP. P. 38.6(a), (d), 38.8(a)(1). Because appellant had failed to request and pay for the reporter’s record, this Court’s August 22, 2017 Order directed appellant to file a brief without that record within thirty days of that Order. See id. 37.3(c)(1), (2). Appellant failed to timely file her brief. See id. 38.6(a)(1). Then after being notified by the Clerk of this Court on September 28, 2017, that this appeal was subject to dismissal for want of prosecution for failure to file the appellant’s brief within ten days of that notice, appellant failed to timely respond. See id. 38.6(d), 38.8(a)(1), 42.3(b), (c). Accordingly, we dismiss the appeal for want of prosecution for failure to timely file a brief. See TEX. R. APP. P. 38.8(a)(1), 42.3(b), (c).
