DENY entered January 5, 2022 In The Court of Appeals Fifth District of Texas at Dallas No. 05-21-00216-CV IN RE MARIAM AYAD, Relator Original Proceeding from the 416th Judicial District Court Collin County, Texas Trial Court Cause No. 416-50435-2021 MEMORANDUM OPINION Before Justices Osborne, Pedersen, III, and Goldstein Opinion by Justice Goldstein In her June 22, 2021 amended petition for writ of mandamus, relator challenges the trial court’s order referring the parties to arbitration per the terms of their prenuptial agreement. Entitlement to mandamus relief requires relator to show that the trial court clearly abused its discretion and that she lacks an adequate appellate remedy. In re Prudential Ins. Co., 148 S.W.3d 124, 135–36 (Tex. 2004) (orig. proceeding). Based on our review of relator’s amended petition, appendix, and supplemental appendices and real party’s response we conclude relator has failed to demonstrate an entitlement to mandamus relief. Accordingly, we deny the amended petition for writ of mandamus. See TEX. R. APP. P. 52.8(a). We lift the stay issued by this Court’s August 26, 2021 order.
