DISMISS; and Opinion Filed August 28, 2017. S In The Court of Appeals Fifth District of Texas at Dallas No. 05-17-00333-CV STATE OF TEXAS FOR THE PROTECTION OF C.W. On Appeal from the 59th Judicial District Court Grayson County, Texas Trial Court Cause No. FA-17-0186 MEMORANDUM OPINION Before Justices Francis, Brown, and Schenck Opinion by Justice Schenck This appeal arises from a protective order signed by the trial court in a suit affecting the parent-child relationship. Section 81.009 of the Texas Family Code allows for appeal of a protective order in a suit affecting the parent-child relationship only when the underlying suit affecting the parent-child relationship becomes final. See TEX. FAM. CODE ANN. § 81.009 (West 2014). Because the suit affecting parent-child relationship is still pending, we requested appellant file a letter brief addressing whether the Court has jurisdiction over the appeal. We cautioned appellant that if the Court determined it lacked jurisdiction, the Court would dismiss the appeal without further notice. See TEX. R. APP. P. 42.3(a). Appellant responded but did not provide any authority establishing the jurisdiction of the Court over the appeal. Accordingly, we dismiss this appeal for want of jurisdiction. See TEX. R. APP. P. 42.3(a). /David J. Schenck/ DAVID J. SCHENCK JUSTICE 170333F.P05 –2– S Court of Appeals Fifth District of Texas at Dallas JUDGMENT STATE OF TEXAS FOR THE PROTECTION OF C.W.
