MEMORANDUM OPINION
Before Chief Justice Wright and Justices O'Neill and Myers
        By letter dated October 22, 2010, the Court notified appellant Luis F. Castillo that the Dallas County District Clerk informed us he has not paid for the clerk's record. We directed appellant to provide written verification either that he has paid for the record or he is entitled to proceed without payment. We warned that failure to comply would result in dismissal of the appeal. See Tex. R. App. P. 37.3(b). To date, appellant has neither provided payment verification nor otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal.
