MEMORANDUM OPINION
Before Justices Morris, Moseley, and Myers
        On June 16, 2010, the Court granted appellant an extension of time to file his brief until seventy-five days after the clerk's record was filed. The clerk's record was filed on June 4, 2010; therefore, appellant's brief was due by August 18, 2010. On August 24, 2010, we sent appellant a letter notifying him that his brief was overdue. We directed appellant to file his brief and an extension motion within ten days, and warned that failure to comply would result in dismissal of the appeal. See Tex. R. App. P. 38.8(a)(1). To date, appellant has neither filed a brief nor otherwise communicated with the Court regarding his appeal. Accordingly, we dismiss the appeal.
