MEMORANDUM OPINION
Before Justices Morris, FitzGerald, and Francis
        By order dated October 7, 2009, the Court ordered appellant to file his brief within thirty days, and on November 9, 2009, we granted appellant a thirty-day extension of time to file his brief. When appellant's brief was not filed by January 12, 2010, we sent appellant a letter directing him to file his brief and an extension motion within ten days. We warned appellant that failure to comply would result in dismissal of his appeal.  See Tex. R. App. P. 38.8(a), 42.3. To date, appellant has neither filed his brief nor otherwise communicated with the Court regarding his appeal. Accordingly, we dismiss the appeal for want of prosecution. See Tex. R. App. P. 38.8(a), 42.3(b).
