MEMORANDUM OPINION
Before Justices O'Neill, Francis, and Lang
Appellant has not paid the filing fee due in this appeal. By letter dated September 22, 2009, the Clerk of the Court directed appellant to pay the $175 filing fee within ten days. Appellant was warned that we would dismiss the appeal if he failed to comply with the Clerk's instruction. Nevertheless, to date, appellant has not paid the $175 filing fee. Accordingly, we DISMISS the appeal. See Tex. R. App. P. 42.3(c).
