MEMORANDUM OPINION
Before Justices O'Neill, Francis, and Lang
        The Court has before it the parties' September 24, 2009 join motion to dismiss the appeal with instructions to the trial court on distribution of funds in the court's registry. The parties state that they have reached a settlement agreement and ask that we dismiss the appeal, direct the trial court to distribute the funds on deposit in the trial court's registry in accordance with the settlement agreement, and direct the clerk to release appellant's case deposit in lieu of supersedeas bond. We grant the motion as follows: We order the trial court to distribute the funds on deposit in the trial court's registry in accordance the parties' settlement agreement. We dismiss the appeal. See Tex. R. App. P. 42.1(a).
