DONALD FRANK GUILDER,FROM A DISTRICT COURT

        APPELLANT,

v.

THE STATE OF TEXAS,

        APPELLEE.OF DALLAS COUNTY, TEXAS

BEFORE JUSTICES WHITHAM, LAGARDE AND KINKEADE
CONCURRING OPINION BY JUSTICE LAGARDE
JUNE 19, 1989

In light of the very close majority holding in Williams v. State, 767 S.W.2d 872, 875 (Tex. App.--Dallas 1989, pet. ref'd)(en banc), I am compelled by the doctrine of stare decisis to join the majority decision to abate this appeal and remand this case to the trial court for cross-examination of the prosecutor. Nevertheless, I remain of the opinion expressed in my dissent in Williams.
