MULTNOMAH COUNTY ASSESSOR, Defendant. ) ) ) ) ) ) ) ) ) TC-MD 070076D DECISION OF DISMISSAL This matter is before the court on Plaintiff s verbal Motion to Dismiss, made April 17, 2007, requesting that his Complaint be dismissed. At the case management conference held on April 3, 2007, Defendant s Motion to Dismiss, filed March 8, 2007, was discussed. At the conclusion of the conference, Plaintiff requested time to review the statutory requirements of ORS1 305.288 and respond to Defendant s Answer. Plaintiff stated that his response would be submitted by April 13, 2007. On April 17, 2007, a member of the court s staff telephoned Plaintiff, asking if he had mailed his response. Plaintiff stated that he was verbally withdrawing his appeal because he does not have time to put a response to Defendant s Answer in writing.
