On June 20, 2005, Plaintiffs Complaint was received by the court challenging Defendant s Notice of Proposed Adjustment and/or Distribution, dated April 26, 2005, for the 2004 tax year. After reviewing Plaintiffs Complaint and additional information, Defendant agrees to provide Plaintiffs with the relief requested. Because the parties are in agreement, the case is ready for judgment. Now, therefore, IT IS ADJUDGED that for tax year 2004, Defendant shall cancel its assessment notice, dated April 26, 2005, and issue or otherwise credit to Plaintiffs a refund of $633 with statutory interest, if any.
