IN THE OREGON TAX COURT MAGISTRATE DIVISION Small Claims Income Tax THOMAS J. LATULIP, ) ) ) ) ) ) ) ) ) ) Plaintiff, v. DEPARTMENT OF REVENUE, State of Oregon, Defendant. TC-MD 040984B DECISION and JUDGMENT This matter is before the court on the agreement of the parties. On September 14, 2004, the court received Plaintiff s Complaint challenging Defendant s Notice of Deficiency for the 2003 tax year. In its Answer filed September 29, 2004, Defendant requested this case be dismissed as it agreed to provide Plaintiff with the relief requested. Because the parties are in agreement, the case is ready for judgment. Now, therefore, IT IS ADJUDGED that for tax year 2003, Defendant in its Answer, said it already had tranferred $800 from Plaintiff s business account to his personal income tax account; and IT IS FURTHER ADJUDGED that Defendant shall refund $801.63 with statutory interest.
