At the September 24, 2003, case management conference, the court agreed to place the case in abeyance pending the result of Plaintiff's appeal with the Internal Revenue Service. Plaintiff agreed to notify the court when her appeal with the Internal Revenue Service was resolved. Plaintiff did not respond to a message left by court personnel on February 17, 2004, regarding the status of her federal appeal. The court s letter dated October 11, 2004, sent to 2709 J Street; Springfield, Oregon 97477, advised Plaintiff that failing to provide the information regarding her federal appeal could result in dismissal. As of this date, Plaintiff has not responded to the court s request. As a result, the court concludes the appeal should be dismissed.
