IN THE OREGON TAX COURT MAGISTRATE DIVISION Small Claims Income Tax MARGARET E. SHAW, Plaintiff, v. On October 22, 2003, Defendant filed a letter with the court stating it would reissue the refund check previously mailed to Plaintiff. Plaintiff received the original refund check in the amount of $299, but mailed it back to Defendant. Defendant has no record of receiving the returned check. Plaintiff is entitled to the refund and Defendant agrees to provide Plaintiff with the relief requested. Because the parties are in agreement, the case is ready for judgment. Now, therefore, IT IS ADJUDGED AND DECREED that for tax year 2002, Defendant shall reissue Plaintiff s refund check in the amount of $299.
