On January 17, 2003, Plaintiff filed his Complaint challenging Defendant's Notice of Deficiency for the 1999 tax year. After reviewing Plaintiff's appeal Defendant agrees to provide Plaintiff with the relief requested. Because the parties are in agreement, the case is ready for judgment. Now, therefore, IT IS ADJUDGED AND DECREED as follows: For tax year 1999, Defendant shall cancel its Notice of Deficiency, dated November 9, 2001. The credit card payment of $126.97 will be refunded back to the credit card company. The payment of $452.00, with statutory interest, will be refunded back to Plaintiff unless he has other amounts due to the State of Oregon.
