IN THE OREGON TAX COURT MAGISTRATE DIVISION Income Tax DAVID V. HAUN, Plaintiff, v. DEPARTMENT OF REVENUE, STATE OF OREGON, Defendant. ) ) ) ) ) ) ) ) ) ) TC-MD 020008F DECISION This matter has been the subject of two previous Orders of the court.1 In an Order dated April 8, 2002, the court ordered Defendant to cease its collection efforts against Plaintiff during the pendency of the appeal. In an Order dated October 1, 2002, the court denied Defendant's motion to dismiss. In that order, the court held that the taxes at issue were not discharged by Plaintiff s chapter 7 bankruptcy. In a status conference held on November 6, 2002, Plaintiff stated that he did not disagree as to the amounts of the taxes owing. Because the court has previously held that the taxes owing were not discharged by Plaintiff's chapter 7 bankruptcy and there is no disagreement as to the amounts of the taxes owing, there is no reason for this appeal to go forward.
