The terms of the agreement are set forth in Defendant s November 8, 2001, letter to the court, and were consented to by Plaintiffs representative during the status conference held by the court on January 7, 2002. The dispute is fully resolved as set forth below. Accordingly, a Judgment can be issued in this case. Now, therefore, IT IS HEREBY ADJUDGED AND DECREED that Defendant s assessment for 1996 is cancelled and that Plaintiffs payment of $7,563 shall be either refunded or applied to outstanding state tax liabilities for other years.
