IN THE MAGISTRATE DIVISION OF THE OREGON TAX COURT Property Tax WILLIAMS INVESTMENT CO., Plaintiff, v. CLATSOP COUNTY ASSESSOR, Defendant. ) ) ) ) ) ) ) ) ) No. 010672E DECISION This matter is before the court upon the agreement of the parties. On April 25, 2001, plaintiff filed its appeal challenging the real market value of the property identified as Account No. 11595 for the 2000-01 tax year. In response, the county requested that the case be dismissed claiming plaintiff failed to exhaust its administrative remedy. On July 6, 2001, the court entered an Order Denying Defendant s Motion to Dismiss. The findings and conclusions contained in that Order are incorporated herein by reference. On July 26, 2001, the court held a status conference in the case to discuss how to proceed with the appeal. During the proceeding, defendant proposed reducing the real market value of the subject property to $750,000. After taking time to consider defendant s proposal, plaintiff, in a letter dated July 27, 2001, stated it would accept defendant s offer. Because the parties are in agreement, the case is ready for decision. Now, therefore; IT IS THE DECISION OF THIS COURT that the findings and conclusions contained in the court s Order Denying Defendant s Motion to Dismiss, dated July 6, 2001, are incorporated herein by reference; and /// DECISION 1 IT IS FURTHER DECIDED that the 2000-01 real market value of the property identified as Account No. 11595 was, as agreed: Land RMV: $630,153 Improvements RMV: $119,847 Total RMV: $750,000 IT IS FURTHER DECIDED that the county shall correct the assessment and tax rolls to reflect the above values. Any refund due following this correction shall be promptly paid with statutory interest pursuant to ORS 311.806 and 311.812.
