IN THE MAGISTRATE DIVISION OF THE OREGON TAX COURT Income Tax WILLIAM M. AND HELEN L. BEERS, Plaintiffs, v. DEPARTMENT OF REVENUE, STATE OF OREGON, Defendant. ) ) ) ) ) ) ) ) ) ) No. 001102D DECISION On November 16, 2000, the court granted defendant's request that this matter be held in abeyance pending the outcome of an administrative conference between plaintiffs and defendant. On January 8, 2001, defendant submitted a copy of its Conference Decision Letter (letter) dated December 28, 2001 (sic). Its letter stated that the Notice of Deficiency was canceled, the requested refund was issued and the interest on underpayment of estimated tax was $102 as computed by plaintiffs. Defendant requested that the case be removed from abeyance and dismissed "since there is no longer any disagreement." After a full review and the court being fully advised, now, therefore; IT IS THE DECISION OF THE COURT that plaintiffs' appeal is reactivated and dismissed.
